Note that EKRA’s reach is broader than the Anti-Kickback Statute, which applies only to “federal healthcare programs” — e.g., Medicare, Medicaid, Tricare, etc. In particular, the employee exemption, relevant to the S&G Labs Haw., S&G Labs Haw., 18 U.S.C. § 24(b) (emphasis added). EKRA also contains several exemptions.
